New Virginia Law Underinsured Coverage/UIM Policy Limits
Beginning July 1 2023, the new Virginia law governing Uninsured Motorist (UIM) insurance coverage and Underinsured Motorist (UM) coverage will go into effect. This new law will trigger a big change in how liability insurance coverage works in Virginia. Read on for more information about this important law.
Mike Ritchie discusses changes to Virginia’s Uninsured Motorist coverage law in this video:
Liability Insurance Coverage: How it Currently Works With Underinsured Motorist Coverage
Right now, underinsured motorist coverage gets credit for the available liability coverage. For instance, let’s say you are in a car crash in Virginia and you have a case that’s worth $150,000. Next, imagine that the at fault party in the accident has liability coverage in the amount of $100,000.00 and you have a $100,000.00 policy as well for liability coverage and underinsured motorist coverage. Under this scenario, until July 1 2023, you would not have access to any underinsured motorist coverage, as your insurance company would get credit for the available liability coverage.
Liability Coverage in Combination with UIM Coverage On July 1 2023
On July 1 2023, the law will change and will give coverage to the injured party for both liability insurance coverage and underinsured motorist coverage. So, let’s look at the example above again where you have a case that’s worth $150,000. Again, the liability coverage for the at fault party is $100,000 and you have a liability/underinsured motorist coverage policy with $100,000 in limits. Under the new law, you would have a total of $200,000.00 in possible insurance coverage for your injury claim.
Underinsured Motorist Coverage Payments
Underinsured motorist coverage payments is a complex topic that requires an experienced attorney to determine the total coverage available for payment. Many injury victims who try to handle their cases on their own end up not getting all of the coverage available to them. They don’t understand liability limits and have no idea that they can negotiate with their own insurance company for underinsured motorist coverage payments when there isn’t enough liability insurance coverage.
If you’ve been injured in a car crash and there is not enough liability coverage to pay what your claim is worth, you will want to talk with a lawyer who is experienced in dealing with serious injuries and a serious injury claim. The lawyers at the Ritchie Law Firm know how to investigate to determine if there is available underinsured motorist coverage when there isn’t enough liability insurance coverage. Don’t leave the insurance coverage on your claim to chance. You will want an expert on your side who can review the liability coverage available and determine if your insurance company will provide underinsured motorist coverage.
