Virginia Motorcycle Accidents
The outcome of many motorcycle accidents is unfortunately deadly. Because motorcycles are frequently less visible to other drivers and are more easily turned over, motorcyclists and their passengers are often more susceptible to injury when involved in a motorcycle accident.
Motorcycle Accidents = Deadly Results
According to the National Highway Traffic Safety Administration, in 2022, 6,218 motorcyclists died in crashes, which represented 15% of all traffic fatalities. The data from 2022 shows that motorcyclists are about 27 times more likely to die in crashes than are occupants of passenger vehicles.
The NHTSA also estimates that, in 2022, 35% of motorcyclists involved in fatal crashes were speeding, and 42% of motorcyclists who died in single-vehicle crashes were alcohol-impaired. Lastly, only 66.5% of motorcyclists wore DOT compliant helmets in 2022, so many lives may have been saved if DOT compliant motorcycle helmets were worn more frequently.
Causes of Motorcycle Crashes
Motorcycle crashes can stem from a variety of factors, each contributing to the risk and severity of an accident. Speeding is a significant cause, as excessive speed reduces a rider’s ability to react to hazards and increases the impact’s severity. Distracted driving, such as texting or talking on the phone, also heightens the risk of a motorcycle crash. Failure to yield to other vehicles or pedestrians can lead to dangerous collisions, while reckless driving behaviors like weaving through traffic or running red lights further escalate the risk.
Road hazards, including potholes or debris, can cause a motorcycle to lose control and crash. Additionally, defects in the motorcycle or other vehicles can contribute to accidents. Weather conditions, such as rain or snow, make road conditions hazardous, increasing the likelihood of a crash. Understanding these causes is crucial for both motorcyclists and other vehicle drivers to enhance road safety and prevent accidents.
Augusta County, Virginia, Motorcycle Accident
In July, 2020, the Virginia State Police reported a fatal motorcycle accident which occurred in Augusta County just on Lyndhurst Road (Route 664). According to the press release from the State Police, Brandon Galloway of Waynesboro, Virginia, was driving a 2014 Lexus when he ran off the right side of the road, over-corrected. Galloway then swerved into the westbound lane of Route 664 hitting Timothy Painter, who was driving a 2003 Harley Davidson. The driver of a second motorcycle, Roger Holmes, ran off the road and struck a highway sign to avoid a collision with Galloway.
This incident is an example of the many fatal crashes involving motorcycles. Timothy Painter died at the scene of the accident. Roger Holmes was flown to UVA Medical Center with serious injuries. Galloway has been charged with involuntary manslaughter.
Motorcyclist Safety Tips
Motorcyclists can take several proactive steps to reduce their risk of being involved in a crash. Wearing protective gear, such as helmets, gloves, and protective clothing, is essential in minimizing injuries in the event of an accident. Adhering to traffic laws, including observing speed limits and right-of-way rules, can significantly lower the risk of a crash.
Visibility is another critical factor; wearing brightly colored clothing and using headlights can make motorcyclists more noticeable to other drivers. Riding defensively by anticipating the actions of other drivers and being prepared to react can also help prevent accidents. Additionally, taking a motorcycle safety course can improve riding skills and further reduce the risk of a crash. By following these safety tips, motorcyclists can enhance their safety and enjoy a safer riding experience.
Motorist Awareness and Responsibility
Motorists play a crucial role in reducing the risk of motorcycle crashes. Being aware of motorcycles on the road and taking steps to avoid collisions is essential. Following traffic laws, such as adhering to speed limits and right-of-way rules, helps create a safer environment for all road users. Patience is also key; giving motorcycles plenty of space and avoiding aggressive driving behaviors can prevent accidents.
Avoiding distractions, such as texting or talking on the phone while driving, is vital in reducing the risk of a crash. By staying focused and attentive, motorists can better detect and respond to motorcycles, contributing to overall road safety. It is a shared responsibility to ensure that all road users, including motorcyclists, can travel safely.
Augusta County Motorcycle Accident Statistics

In Augusta County, there were 12 motorcycle fatalities in the same year, accounting for 2.4% of all traffic fatalities in the county. These statistics highlight the importance of road safety measures and awareness to prevent fatal motorcycle accidents. Understanding the local context can help both motorcyclists and other drivers take necessary precautions to reduce the risk of accidents.
How Long Can I Wait to Call a Lawyer?
When you’re injured in a motorcycle accident in Virginia or West Virginia, you must be aware of the statute of limitations which applies in your particular case. The statute of limitations refers to the time you have following an accident to file a lawsuit. In Virginia and West Virginia, this time limit depends upon the circumstances of your accident and injury. The time limitation starts to run on the date of the accident. Filing a claim with an insurance company does not extend or delay the time.
The longer you wait to contact an attorney, the greater the risk that the statute of limitations time limit will expire. If it does, you may lose your right to sue the at-fault party and recover compensation for your injuries. If you have suffered a motorcycle accident injury and someone else is at fault, you should contact a personal injury attorney at the earliest possible time. Contacting an experienced personal injury lawyer early in your case will help prevent deadlines from expiring and will allow your case to be properly prepared.
To be able to determine whether you have a case, your lawyer needs to thoroughly investigate the details about your accident and injuries. Investigating the accident and collecting information is much easier if it occurs quickly after the accident has happened. A time delay can result in many problems like lost evidence and witnesses who can’t be found.
When you hire a lawyer to handle your motorcycle accident claim, he or she will first negotiate with the insurance company to try to settle your claim. If settlement negotiations break down, your attorney will prepare to file a lawsuit and prepare your case for trial. For this reason, it is especially important that you get an experienced lawyer to help with your case, such as one certified through the National Board of Trial Advocacy.
